Barack Obama-appointed activist Judge James Boasberg has vowed to hold President Donald Trump in “criminal contempt” over the administration’s deportations of violent illegal aliens.
On Wednesday, Boasberg claimed to have “probable cause” to hold the Trump administration in contempt.
The major escalation relates to the Trump administration refusing to return two planes deporting violent illegal alien gang members to El Salvador last month.
In the 48-page opinion, Boasberg said the court had ultimately determined that the Trump administration’s actions on the March 15 deportation flights demonstrate a “willful disregard” for the court.
The judge claims that the president’s actions are sufficient for the government to be found in “criminal contempt.”
The deportation flights landed in El Salvador after Boasberg issued a bench ruling ordering their immediate return to U.S. soil.
However, the flights had already left U.S airspace when Boasberg issued a politically motivated ruling.
The judge issued a deadline for the Trump administration to answer his questions by April 23.
If Trump officials fail to comply with the demand, Boasberg threatened to refer the matter for potential prosecution.
Complying with the demand would involve identifying the individuals in the Trump administration responsible for what he described as “contumacious conduct.”
Boasberg said Trump officials must comply by “determining whose ‘specific act or omission’ caused the noncompliance.”
The Department of Justice (DOJ) could then request that the contempt be prosecuted by an attorney for the government.
Should a U.S. attorney decline to prosecute the matter, the DOJ could “appoint another attorney to prosecute the contempt.”
In the ruling, the Democrat judge continued:
“The Court does not reach such conclusion lightly or hastily; indeed, it has given Defendants ample opportunity to rectify or explain their actions.
“None of their responses has been satisfactory…”
Boasberg added in his Wednesday order:
“As this Opinion will detail, the Court ultimately determines that the Government’s actions on that day demonstrate a willful disregard for its Order, sufficient for the Court to conclude that probable cause exists to find the Government in criminal contempt.”
