House Oversight Committee Chair James Comer (R-KY) has just dropped the hammer on the previous administration in a bombshell new report, demanding a criminal investigation into the use of an autopen by former President Joe Biden’s White House handlers.
Comer is calling on the Department of Justice (DOJ) to open a “comprehensive” criminal investigation into the use of Biden’s autopen.
The autopen is a mechanical device that reproduces signatures.
It’s fairly standard practice for the president to authorize the use of an autopen signature for convenience and efficiency.
However, congressional investigators are raising concerns that White House aides may have authorized executive actions without Biden’s full awareness during his time in office.
The demand follows the release of a 100-page Oversight Committee report on Tuesday detailing the findings of a months-long investigation into what Republicans describe as a coordinated effort by Biden’s inner circle to conceal signs of mental decline and to continue governing through aides and proxies.
“Faced with the cognitive decline of President Joe Biden, White House aides — at the direction of the inner circle — hid the truth about the former president’s condition and fitness for office,” the report said.
The committee alleges that the former president’s staff used the autopen to authorize pardons and executive orders without verifying whether Biden personally approved them.
“In the absence of sufficient contemporaneous documentation indicating that cognitively deteriorating President Biden himself made a given executive decision, such decisions do not carry the force of law and should be considered void,” the report states.
Comer’s report urges the DOJ to review all executive actions Biden signed between January 20, 2021, and January 19, 2025, with particular focus on acts of clemency, including pardons and commutations.
Hunter Biden’s Role in Pardon Discussions
The report also raises new questions about Hunter Biden’s involvement in the White House pardon process, citing testimony from former Chief of Staff Jeff Zients.
Zients told investigators that Hunter Biden was present for “a few meetings” on pardons near the end of the administration.
“It was toward the end,” Zients said, according to a transcript excerpt included in the report.
“What comes to mind is the family discussions.
“But I don’t know — that doesn’t mean that was it.
“It was the pardons toward the end, very end of the administration.
“And I think it was a few meetings, not many meetings.”
The Oversight Committee claims Hunter’s participation extended to pardon discussions for five Biden family members, as well as Dr. Anthony Fauci, Gen. Mark Milley, and members of Congress involved in the anti-Trump January 6th “investigation.”
GOP Report Targets Biden’s Former White House Doctor
Comer’s report also takes aim at Dr. Kevin O’Connor, Biden’s former White House physician.
The chairman is accusing O’Connor of failing to properly evaluate the president’s mental state and of potentially issuing “grossly misleading medical assessments.”
O’Connor invoked the Fifth Amendment during his deposition, refusing to answer questions about his medical care for Biden.
Comer subsequently referred the matter to the D.C. Health Board of Medicine, asking the board to investigate whether O’Connor “succumbed to political pressure from the inner circle” or provided false medical information to the public.
“His refusal to answer questions about the execution of his duties as physician to the president — combined with testimony indicating that Dr. O’Connor may have succumbed to political pressure — legitimizes the public’s concerns that Dr. O’Connor was not forthright in carrying out his ultimate duties to the country,” the report said.
O’Connor’s attorneys previously claimed that he invoked his Fifth Amendment rights due to concerns about violating doctor–patient confidentiality.
White House and Allies Dismiss Investigation
Biden’s spokesperson blasted Comer’s findings as “baseless” and politically motivated.
“This investigation into baseless claims has confirmed what has been clear from the start: President Biden made the decisions of his presidency,” a Biden spokesperson said in a statement.
“There was no conspiracy, no cover-up, and no wrongdoing.
“Congressional Republicans should stop focusing on political retribution and instead work to end the government shutdown.”
Biden’s allies have repeatedly dismissed suggestions of cognitive decline, arguing that Republican lawmakers and the media amplified the issue following his widely criticized June 2024 debate against President Donald Trump.
In a July interview with The New York Times, Biden insisted he had made “every decision” on his own while in office.
Comer’s report represents the latest effort by House Republicans to scrutinize the decision-making structure of the Biden White House.
It comes as questions persist about the use of autopen signatures, executive authority, and White House transparency during Biden’s presidency.
