The Department of Homeland Security (DHS) has slammed a Joe Biden-appointed “activist” judge for ordering the release of over 600 illegal aliens arrested in the Chicago area.
The Democrat-aligned federal judge ordered the DHS to release hundreds of illegals being held at a suburban Chicago detention facility.
U.S. District Judge Jeffrey Cummings is accusing the agency of “repeated, material violations” of a court-approved consent decree that limits who can legally be detained.
Cummings ruled that the detainees at the Broadview ICE center must be released “on bond and into ICE’s Alternatives to Detention (ATD) program” by Nov. 21.
The judge cited what he called a “pattern of unlawful arrests and confinement.”
The order comes from Margarito Castañon Nava v. DHS, a class-action lawsuit alleging that federal agents unlawfully detained migrants who were not subject to mandatory detention or final removal orders.
Democrats argue that the arrests were a direct violation of a 2021 Biden-era consent decree inherited by the Trump administration.
In his ruling, Cummings accused DHS of keeping migrants in “unsafe and unsanitary” conditions.
The judge argued that the illegals were held in overcrowded rooms “next to overflowing toilets.”
Cummings also said the department’s sudden shift in its detention policies amounted to a “180-degree change” from its previous stance.
If carried out, the move will result in one of the largest single-day mass releases of ICE detainees in Illinois in years.
The order will free hundreds of individuals swept up during “Operation Midway Blitz.”
The operation is a Trump administration enforcement effort that radical activists claim destabilized communities across Chicago.
Immigration activists immediately celebrated the ruling.
“Today was a good day as the court ordered the immediate release of 13 people who have been wrongfully arrested and detained by federal immigration officials,” said Michelle Garcia, deputy legal director at the ACLU of Illinois.
“More than 600 others may soon walk free as the court enforces our agreement with the federal government — a step toward accountability for years of unlawful arrests.”
But DHS officials condemned the decision as a dangerous act of judicial activism that puts Americans at risk.
In a statement, Tricia McLaughlin, assistant secretary for Public Affairs at DHS, warned:
“At every turn, activist judges, sanctuary politicians, and violent rioters have actively tried to prevent our law enforcement officers from arresting and removing the worst of the worst.
“Now an activist judge is putting the lives of Americans directly at risk by ordering 615 illegal aliens be released into the community.”
Judge Cummings instructed DHS to identify detainees considered “high public safety risks” who may remain in custody and ordered the agency to file a compliance report by Nov. 24.
The ruling marks a significant escalation in the ongoing conflict between federal courts, immigration activists, and law enforcement.
It opens the door to a sweeping release of illegal immigrants into the Chicago region in the coming days.
