The U.S. Department of Justice (DOJ) has filed a federal charge against the man accused of spraying a liquid on Democrat Rep. Ilhan Omar (D-MN) during a chaotic town hall in Minneapolis this week.
The DOJ’s charge has elevated what began as a state assault case into a serious federal prosecution.
According to a criminal complaint filed in U.S. District Court in Minnesota and obtained by Fox News, Anthony James Kazmierczak, 55, is accused of having “forcibly assaulted, opposed, impeded, intimidated, and interfered with United States Representative Ilhan Omar.”
The case has been assigned to Dulce J. Foster.
The incident occurred moments after Omar called for the resignation or impeachment of Homeland Security Secretary Kristi Noem following recent fatal shootings involving federal immigration agents in Minneapolis.
Kazmierczak, who has prior convictions for two DUI offenses, was initially charged at the state level with third-degree assault and booked into the Hennepin County Jail.
Federal prosecutors later intervened and filed the federal charge.
According to the complaint, Kazmierczak used a syringe to spray Omar with a liquid during the town hall.
A Minneapolis Police Department officer stated that a hazmat specialist “field tested the substance from the syringe and determined it was water and apple cider vinegar.”
“The substance was sent to a state laboratory for further testing and analysis,” the complaint said.

Body camera footage reviewed by investigators reportedly captured Kazmierczak making an admission during his arrest.
“An MPD Detective Sergeant reviewed body-worn camera footage of MPD’s arrest of Kazmierczak,” the filing stated.
“The detective noted that Kazmierczak made a spontaneous utterance to the effect of ‘I squirted vinegar’ at the time he was being arrested.”
The complaint also detailed prior remarks attributed to Kazmierczak.
An FBI special agent interviewed a close associate of the suspect, who said Kazmierczak had previously discussed Omar.
He allegedly stated, “Somebody should kill that b—-,” referring to the congresswoman.
Omar was not injured in the incident and continued the town hall after the suspect was removed.
The case remains under investigation as federal prosecutors pursue the charge.
The DOJ’s intervention comes amid growing allegations that Omar had staged an attack for political reasons.
Omar immediately used the incident blast President Donald Trump for calling for investigations into the congresswoman.
In a statement, Omar blamed Trump’s rhetoric for the alleged assault.
Trump is among those who believe the incident was staged.
“I think she’s a fraud,” Trump told ABC News.
“She probably had herself sprayed, knowing her.”
