California Democrat Gov. Gavin Newsom is under fire after his state’s “sanctuary” policies led to a 71-year-old man being killed by a drunk illegal alien.
The Trump Department of Homeland Security is demanding answers from Newsom after Barry William Tutt, an American citizen, was killed in a hit-and-run involving an illegal alien who was allegedly driving under the influence in Orange County.
According to DHS, 57-year-old Mexican national Humberto Munoz-Gatica was intoxicated when he struck and fatally injured Tutt last Friday.
Munoz-Gatica allegedly fled the scene before witnesses helped authorities locate him.
He was arrested and now faces charges related to hit-and-run and suspicion of DUI, the Orange County Sheriff’s Department said.
Deputies found Tutt severely injured at the scene. He was transported to a local hospital, where he later died.
In a statement, DHS confirmed it has lodged a detainer request asking local authorities to hold Munoz-Gatica and transfer him to ICE custody.
The department publicly pressed Newsom over California’s refusal to cooperate.
“How many Americans must be killed before @GavinNewsom’s sanctuary state of California works with federal law enforcement—instead of against them?” DHS posted on X.
DHS Assistant Secretary Tricia McLaughlin said:
“Unfortunately, Gavin Newsom’s California is a sanctuary state and does not cooperate with ICE.”
McLaughlin called Tutt’s death “yet another example of sanctuary and open border policies putting American lives at risk.”
Newsom’s office pushed back.
Brandon Richards, a spokesperson for the governor, said in a statement:
“Despite the Trump Admin’s repeated false claims, California cooperates with the federal government when it comes to criminals.”
DHS further revealed Munoz-Gatica has a prior conviction for grand theft and first entered the United States on a tourist visa that expired in 2008.
In 2011, he was arrested by ICE under the Obama administration but was later released.
“This criminal illegal alien from Mexico, Humberto Munoz-Gatica, was released by the Obama Administration,” DHS said.
“He NEVER should have been here.”
Newsom, who is widely believed to harbor 2028 presidential ambitions, has been one of the Democratic Party’s most vocal critics of President Trump’s immigration enforcement policies.
During anti-ICE riots in Los Angeles in June, he blamed “continued chaotic federal sweeps, across California, to meet an arbitrary arrest quota.”
He called the operations “as reckless as they are cruel,” adding that “Donald Trump’s chaos is eroding trust, tearing families apart, and undermining the workers and industries that power America’s economy.”
DHS argues that California’s sanctuary laws have done exactly the opposite by shielding dangerous offenders like Munoz-Gatica until tragedy strikes.
