Republican Rep. Clay Higgins (R-LA) has introduced a resolution calling for the censure of NDemocrat Rep. LaMonica McIver (D-NJ), who was federally indicted for allegedly obstructing Homeland Security agents during an immigration facility visit in May.
The resolution also demands McIver’s removal from the House Homeland Security Committee.
It cites a clear conflict of interest due to her involvement in national security oversight.
Higgins argues that McIver’s continued role on the Homeland Security Committee, which holds oversight power over federal immigration enforcement, is untenable given her indictment for obstructing federal officers.
“Her continued service on the committee would represent a significant conflict of interest,” the resolution states, further adding that McIver’s actions do not reflect “creditably on the House” as required by the Rules of the House of Representatives.
In response, McIver fired back at Higgins’ resolution.
McIver claims the move is politically motivated.
“Clay Higgins is a bigot who wants to be back in the news,” McIver told Axios in a statement through her spokesperson.
“This resolution aims to kick me off the committee that presides over the Department of Homeland Security and shame me for doing the oversight work that is my job.
“Good luck, Clay,” McIver added.
The resolution specifically refers to the three-count indictment McIver faces, which charges her with assaulting, resisting, impeding, and interfering with federal officers during a May 9 incident at the Delaney Hall Federal Immigration Facility in Newark, New Jersey.
During a congressional oversight visit, which coincided with an immigration protest, McIver allegedly obstructed federal officers’ attempts to arrest Newark Mayor Ras Baraka after he entered the facility’s secured area.
According to the Justice Department’s press release, McIver put her arms around Baraka and “slammed her forearm” into one officer while grabbing another.
The indictment further claims McIver’s actions led to interference with the federal officers’ lawful duties.
McIver pleaded not guilty during a court appearance last month.
She described the charges as politically motivated, claiming that the “Trump administration and his colleagues or cronies” had weaponized the federal government to target political opponents.
“Anyone who criticizes them, anyone who fights back against them, finds themselves in these hairs that we are in today,” McIver added.
The Democrat representative, who is set for trial on Nov. 10, remains defiant in the face of the charges.
Higgins, however, emphasized that McIver should not be allowed to remain on a committee with authority over federal agencies she is accused of obstructing.
According to House Republican rules, members who are indicted are required to give up all committee assignments.
However, under Democrat rules, only leadership positions need to be relinquished.
Higgins criticized the discrepancy, stressing that McIver’s continued participation on the Homeland Security Committee undermines the integrity of the committee’s work and the oversight it is meant to provide.
As the situation develops, Republicans are pushing for more accountability.
Meanwhile, McIver remains steadfast in her defense, signaling an ongoing political clash centered on the integrity of federal oversight and the role of Congress in addressing alleged misconduct.
