Disgraced former FBI Director James Comey praised the Democrat-aligned federal judge who dismissed the criminal case against him this week.
Comey is arguing that the indictment was driven by political animus and mishandled by prosecutors.
The ruling, however, is already being challenged by President Donald Trump’s administration.
The Trump admin maintains that the case was properly brought and plans to continue pursuing legal action.
Activist Judge Cameron Currie, a Bill Clinton appointee, threw out the false-statements charges on Monday.
The judge argued that the prosecutor who handled the case, interim U.S. Attorney Lindsay Halligan, had not been lawfully appointed.
Currie’s ruling also invalidated a separate indictment against New York’s Democrat Attorney General Letitia James on the same grounds.
Comey immediately seized on the ruling as vindication, issuing a sharply worded statement.
“I’m grateful that the court ended the case against me, which was a prosecution based on malevolence and incompetence, and a reflection of what the Department of Justice has become under Donald Trump, which is heartbreaking,” Comey said, also thanking the lawyers who defended him.
He added that the dismissal carried implications beyond his own case.
“This case mattered to me personally, obviously, but it matters most because a message has to be sent,” Comey said.
“That the president of the United States cannot use the Department of Justice to target his political enemies.
“I don’t care what your politics are.
“You have to see that as fundamentally un-American and a threat to the rule of law that keeps all of us free.”
Comey: Trump Will “Continue Coming After Me”
Comey said he expects the administration to pursue additional actions despite the setback, urging Americans to “stand up” against what he called “the fools who would frighten us.”
He continued by suggesting President Trump is a “would-be tyrant.”
The Trump administration, for its part, argues Halligan’s appointment was valid and signals the Justice Department’s intent to appeal.
Attorney General Pam Bondi has already announced that Halligan will continue serving as a special U.S. attorney while the legal fight continues.
Judge’s Ruling Targets Halligan’s Appointment
In the ruling, Currie wrote:
“I conclude that the Attorney General’s attempt to install Ms. [Lindsey] Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid and that Ms. Halligan has been unlawfully serving in that role since September 22, 2025.”
Currie, from South Carolina, was assigned to hear the case to avoid conflicts among Virginia’s federal judges.
Comey’s and James’ challenges were consolidated due to overlapping arguments over Halligan’s authority.
Halligan brought both sets of charges shortly after President Trump removed the previous interim U.S. attorney, Erik Siebert.
Trump pushed for Halligan, a former White House aide and insurance lawyer, to take over.
Currie found that Siebert’s interim term had already expired, meaning the appointment should have shifted to the district court judges until the Senate confirmed a replacement.
Disputes Over Appointments Continue Nationwide
Because Senate Democrats have blocked multiple nominees in blue states, the administration has sometimes used interim appointments to install U.S. attorneys aligned with the president.
Currie’s ruling is the latest in a string of court decisions rejecting interim appointments in California, New Jersey, and Nevada.
The Justice Department’s appeal is expected to determine whether those decisions stand and whether prosecutions handled by Halligan can move forward.
