Jim Jordan Subpoenas Jack Smith Over Anti-Trump Lawfare

House Judiciary Committee Chairman Jim Jordan (R-OH) has just issued a subpoena to former Special Counsel Jack Smith, demanding he sit for a deposition as Republicans intensify their investigation into the prosecutor whose work targeted President Donald Trump.

On Wednesday, Jordan ordered Smith to appear on December 17, according to a copy of the subpoena shared with the media.

“Due to your service as Special Counsel, the Committee believes that you possess information that is vital to its oversight of this matter,” Jordan wrote in the accompanying letter.

The move marks a major escalation in GOP oversight efforts as both House and Senate Republicans have zeroed in on Smith’s sweeping election-related probe of Trump.

Smith’s probe intruded on hundreds of Republican lawmakers, GOP organizations, Trump allies, and even conservative media outlets.

GOP Demands Answers

Smith has repeatedly defended his investigations, which led to two criminal cases against Trump.

One of Smith’s investigations was related to the 2020 election, and another was concerning classified documents.

Both cases were abandoned after Trump’s 2024 victory, with Smith citing DOJ policy discouraging the prosecution of sitting presidents.

Smith has publicly offered to testify in open hearings before both chambers’ Judiciary Committees.

However, a source familiar with Jordan’s strategy told Fox News that the chairman insists on a deposition format.

Jordan argues that it allows each party “an hour at a time” to question the witness, a stark contrast to the fragmented five-minute intervals of a public hearing.

Smith Ordered to Hand Over Internal Records

The subpoena doesn’t stop at Smith’s testimony.

Jordan is also demanding all documents and communications related to Smith’s tenure as special counsel.

It’s a sweeping request that follows a November 12 letter from the DOJ to Smith’s attorneys authorizing what it called a “unique” accommodation.

The DOJ told Smith it would allow him to “provide unrestricted testimony to the Committee, irrespective of potential privilege,” clearing the way for a potentially explosive closed-door session.

Flashpoint in House Majority’s Investigations

Republicans have framed Smith’s investigations as politically motivated efforts to criminalize Trump’s presidency and kneecap his political movement.

Jordan’s subpoena signals that the GOP intends to scrutinize not only Smith’s decisions but the broader DOJ structure that allowed the investigation to expand so aggressively.

Democrats, meanwhile, have dismissed the inquiry as an attempt to punish Smith for pursuing charges against Trump.

However, with the subpoena served and DOJ opening the door to “unrestricted testimony,” the showdown is now all but inevitable.
