An FBI record obtained by Senate Judiciary Committee Chairman Chuck Grassley (R-IA) reveals that the Biden administration’s FBI secretly spied on the private phone records of eight Republican senators.
The spying was conducted during the Biden FBI’s controversial Arctic Frost investigation.
The once-classified document is dated September 2023 and titled “CAST Assistance.”
The title is a reference to the FBI’s Cellular Analysis Survey Team.
The memo shows that the bureau sought “tolling data” on lawmakers’ personal cell phones between January 4 and January 7, 2021.
The case file was labeled: “ARCTIC FROST – Election Law Matters – SENSITIVE INVESTIGATIVE MATTER — CAST.”
Senators Targeted
According to Grassley, the FBI targeted the private records of:
- Sen. Lindsey Graham (R-SC)
- Sen. Bill Hagerty (R-TN)
- Sen. Josh Hawley (R-MO)
- Sen. Dan Sullivan (R-AK)
- Sen. Tommy Tuberville (R-AL)
- Sen. Ron Johnson (R-WI)
- Sen. Cynthia Lummis (R-WY)
- Sen. Marsha Blackburn (R-TN)
Rep. Mike Kelly (R-PA) was also included in the sweep.

“These actions were an unconstitutional breach,” Grassley said in a Senate press release.
“Based on the evidence to date, Arctic Frost and related weaponization by federal law enforcement under Biden was arguably worse than Watergate.”
FBI Under Fire
The surveillance effort occurred while former Director Christopher Wray still led the FBI.
At the time, Jack Smith, who was later appointed special counsel, was directing the Biden Justice Department’s investigation into President Donald Trump.
Grassley said the revelations represent “disturbing and outrageous political conduct by the Biden FBI.”
The senator also urged Attorney General Pam Bondi and current FBI Director Kash Patel to hold those responsible accountable.
The Arctic Frost probe began in April 2022 under then-agent Timothy Thibault.
The operation was officially assigned to Smith in November of that year.
Whistleblower disclosures further revealed that the FBI, with help from Biden White House officials, also obtained government-issued cell phones belonging to Trump and former Vice President Mike Pence.
Pattern of Targeting Republicans
Last month, Grassley released additional records showing the FBI scrutinized 92 Republican-linked individuals and groups, including Turning Point USA, under the same investigation.
“It’s taken years to get records and advance my investigation,” Grassley said.
“But what the public is seeing now demonstrates the importance of congressional oversight and whistleblowers.
“None of this would have been known without them.”
Director Patel weighed in Monday on X, writing:
“We recently uncovered proof that phone records of U.S. lawmakers were seized for political purposes.
“That abuse of power ends now.”
The revelations add to mounting criticism of the FBI’s conduct under Biden, raising comparisons to Watergate and intensifying calls for sweeping reform of federal law enforcement.
