An African migrant has defended himself in court after he was caught raping and impregnating his own 12-year-old daughter.
The defendant has been identified as 40-year-old Tesfalem A., a migrant from Eritrea who is now living in Germany.
The horrific crimes were exposed when the child victim was hospitalized with stomach pains.
However, doctors discovered that the young girl was five months pregnant.
The family ordered doctors to perform an abortion.
After performing the abortion, the doctors took a DNA test from the baby’s umbilical cord.
The DNA test confirmed that the baby’s father was Tesfalem A, who was also the young girl’s father.
The girl was already five months pregnant before she went to the doctor.
The public prosecutor’s office is therefore accusing the Eritrean of serious sexual abuse of a child.
Public prosecutor Daniela Zahrt told the court that the migrant had “sexual intercourse with his daughter” on or around July 23, 2023, and impregnated her.
However, the African migrant defended his actions in court, arguing that he had no memories of what must have happened.
Instead, he claims that alcohol was to blame for the rape.
Tesfalem A. told the court that he suffered a blackout after consuming too much beer with a friend in a bar.
He claims that he was no longer responsible for the horrific crimes he committed against his own child because he wasn’t in his “right mind.”
“I drank too much,” the defendant argued as he sought sympathy from the jury.
“From that point on, I was no longer in my right mind.”
Protesting his innocence to the court, he explained:
“It is indeed true that if someone drinks beyond their means and does not know what they are doing, it must have been like that.”
However, when he first spoke to investigators, he made no mention of being intoxicated.
The change in the story raises the question of whether he is attempting to formulate a justification for his actions after being caught months after the incident.
At the time of the crime, the accused was living with his daughter (now 13) in a refugee shelter in Friedberg.
Tesfalem A. was a single father until his imprisonment and was divorced from the child’s mother.
There was hardly any contact between her and the then twelve-year-old girl.
The victim has now been placed in care.
The girl’s foster parents reported that she was severely traumatized.
To this day, the child has not spoken about what happened to her.
A psychologist who looked after the girl during her time in the clinic reported:
“I asked her if she knew how a child is created.”
The 13-year-old said no.
One of the investigating police officers also testified about the abuse victim, saying:
“She is a child – with an absolutely childlike body and not a teenager in terms of personality either. Shy and reserved.”
The girl’s foster family says she is making “very good progress.”
“She is becoming increasingly open, has made friends, and has settled in well.”
She is also undergoing trauma therapy and did not testify in court.
