Dem Governor Breaks With Joe Biden, Issues Rebuke: “It is too late to impose a federal standard now that we have already developed systems and strategies that are tailored for our specific needs”


A Dem Governor from a red state broke with president Joe Biden and rebuked his admin’s vaccine mandate plans saying it is not the “most effective” or “correct” for the state.

Democratic Kansas Gov. Laura Kelly issued her rebuke on social media. She said: “Yesterday, I reviewed the new vaccine mandate from the Biden Administration. While I appreciate the intention to keep people safe, a goal I share, I don’t believe this directive is the correct, or the most effective, solution for Kansas.

“States have been leading the fight against COVID-19 from the start of the pandemic. It is too late to impose a federal standard now that we have already developed systems and strategies that are tailored for our specific needs.

“I will seek a resolution that continues to recognize the uniqueness of our state and builds on our ongoing efforts to combat a once-in-a-century crisis.”

Kelly is up for reelection next year. The 5th U.S. Circuit Court of Appeals granted an emergency stay of the vaccine requirement Saturday so this may be tied up in the courts for a while.

An appeals court ruled on Saturday to temporarily halt President Biden’s coronavirus vaccine mandate for businesses with 100 employees or more.

The ruling came from the U.S. Court of Appeals for the Fifth Circuit after Texas Attorney General Ken Paxton (R) filed a challenge to the mandate requiring employers with over 100 or more employees to get vaccinated or undergo frequent testing directly with the court.  

The challenge included the states of Louisiana, Mississippi, Utah and South Carolina.

The Biden administration announced that it would issue the law through the Occupational Safety and Health Administration (OSHA) in September. Companies who meet the criteria are required to get their employees fully vaccinated by Jan.4, or workers must test negative for the virus once per week. 

OSHA’s rule includes sending agents to inspect businesses to determine if they are abiding by the mandate. If a business is found to not be in compliance, a company could be fined $136,532.

Paxton argued in the announcement of Texas’s challenge that the mandate goes outside of OSHA’s “limited power and specific responsibilities” and is “flatly unconstitutional.”
