Democrats are continuing to attack the conservative majority on the U.S. Supreme Court by pushing for Justice Samuel Alito’s recusal.
Progressive lawmakers have spent several months needling Chief Justice John Roberts about Alito.
According to Courthouse News, House Democrats recently attempted to pressure the chief justice to back the push against Alito.
They are demanding that Robert elaborate on reports that he had removed Alito “as the lead opinion author for a Supreme Court case involving the Jan. 6, 2021, Capitol riot.”
The same Democrats also questioned Roberts as to why he allowed Alito on the case to begin with.
Democrat Reps. Jamie Raskin (D-MD) and Alexandria Ocasio-Cortez (D-NY) penned a letter to Roberts asking for that information, the reports noted.
Ever since the hoax reports regarding a flag being flown upside down at Alito’s residence, which was done by his wife, Democrats have pressured the chief justice to have him removed from all Jan 6-related cases.
The outlet noted:
“The New York Times reported last month that the chief justice removed Alito from the opinion in May 2023 amid swirling controversy over an upside-down American flag — a symbol co-opted by the ‘Stop the Steal’ election denial movement — which flew outside his Virginia home in the days following the Capitol riot.
“The flag display, which the justice has since said was done by his wife, prompted calls from lawmakers and legal advocates on Alito to recuse himself from cases related to Jan. 6.”
Alito refused to give in to the pressure from his critics, however.
It was Alito’s wife who flew the flag and it had nothing to do with Jan. 6.
The two Democrats argued in the letter that replacing Alito on the majority opinion of the Jan. 6-related ruling “strongly suggests” that the chief justice viewed the flag incident as a potential conflict of interest.
Chief Justice Roberts has contended that it’s not up to him to force justices to recuse themselves from certain cases.
Nevertheless, AOC and Raskin pushed back on that claim.
“The notion that individual Justices can decide for themselves whether their own conduct violates the Constitution, federal law or the court’s code of conduct is untenable in our republic and clearly violates the fundamental and original principle of due process that ‘no man can be a judge in his own case,'” they wrote.
AOC and Raskin demanded that Roberts confirm the New York Times report that said he had, in fact, replaced Alito on the case’s opinion.
They also demanded to know, if Alito was removed, what Roberts’ rationale was to do so.
In addition, the Democrat lawmakers sought to know whether or not Roberts had spoken with Alito or Thomas about recusing from certain related cases.
So far, Roberts hasn’t given in to the radical, progressive Left’s attempt to soil the Supreme Court.
Hopefully, it stays that way.
