Disgraced Hollywood mogul Harvey Weinstein has been hospitalized, according to reports.
The Democrat megadonor and former friend of Bill and Hillary Clinton, who made his millions in show business, scored a legal victory last week.
Weinstein won an appeal to have his 2020 rape conviction overturned.
Last Thursday, New York’s highest court threw out Weinstein’s conviction with a ruling that shocked and disappointed women who celebrated historic gains during the #MeToo era and left those who testified in the case bracing for a retrial against the ex-movie mogul.
The court found the trial judge unfairly allowed testimony against Weinstein based on allegations that weren’t part of the case.
The state Court of Appeals overturned Weinstein’s 23-year sentence in a 4-3 decision, saying “the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts” and permitted questions about Weinstein’s “bad behavior” if he had testified.
It called this “highly prejudicial” and “an abuse of judicial discretion.”
In a stinging dissent, Judge Madeline Singas wrote that the Court of Appeals was continuing a “disturbing trend of overturning juries’ guilty verdicts in cases involving sexual violence.”
She said the ruling came at “the expense and safety of women.”
In another dissent, Judge Anthony Cannataro wrote that the decision was “endangering decades of progress in this incredibly complex and nuanced area of law” regarding sex crimes after centuries of “deeply patriarchal and misogynistic legal tradition.”
The court found the trial judge unfairly allowed testimony against Weinstein based on allegations that weren’t part of the case.
However, shortly after a New York appeals court overturned his conviction on a procedural error, the former Hollywood big-timer and convicted offender was hospitalized, the Washington Examiner reported.
The surprise hospitalization came just one day after the court overturned his conviction.
According to Weinstein’s attorney, Arthur Aidala, the former Hollywood mogul was sent to the hospital for testing.
He described Weinstein’s health as a “train wreck.”
“They examined him and sent him to Bellevue,” Aidala said.
“It seems like he needs a lot of help, physically.
“He’s got a lot of problems.
“He’s getting all kinds of tests.
“He’s somewhat of a train wreck, health-wise.”
The Examiner noted:
Among Weinstein’s many health troubles are cardiac problems, diabetes, sleep apnea, and eye problems. Aidala complained that the prison system was mistreating his client.
His lawyer reiterated that his client had been treated poorly while behind bars.
“He was not treated well,” he said.
“They refused to give him even a sip of water, no food, no bathroom break.
“He’s a 72-year-old sickly man.”
A Daily Mail report noted that Weinstein and the Clintons were “thick as thieves.”
The report detailed the power couple’s relationship with the disgraced Hollywood producer.
Weinstein was also convicted of rape in a second case in 2022.
It was noted that since it’s a separate case, the ruling does not affect that.
The overturned conviction is expected to make its way back into the court system at some point.
