Judge Hands Alec Baldwin Huge Loss, Allows Lawsuit Accusing Actor of ‘Despicable Conduct’ to Proceed

A judge has handed Alec Baldwin a crushing defeat in court by ruling that a lawsuit, accusing the Hollywood star of “despicable conduct” during the fatal shooting on the set of his movie “Rust,” can proceed.

Los Angeles County Superior Court Judge Michael Whitaker refused to toss one of the lawsuits filed against Baldwin over the death of cinematographer Halyna Hutchins.

Baldwin may also still face criminal charges in that case and has settled one civil lawsuit over the death already.

The embattled actor was trying to get a lawsuit filed against him by script supervisor Mamie Mitchell tossed.

She accuses Baldwin of “recklessly” firing the gun that killed Hutchins, 42.

Mitchell was standing near Hutchins during the fatal shooting.

Whitaker ruled that Mitchell can proceed with her claims of assault, intentional infliction of emotional distress, and negligence against Baldwin.

Whitaker said:

“For pleading purposes, the Court finds the second amended complaint alleges facts sufficient to establish despicable conduct carried out by [the defendants] with a willful and conscious disregard of the rights or safety of others.

“Accordingly, the court denies the motion to strike.”

Mitchell’s lawyer, Gloria Allred, said:

“We are very happy that we won, and that the court today permitted us, over the objection of Alec Baldwin, to proceed in our lawsuit against him on our theories of assault, intentional infliction of emotional distress, and negligence.

“Ms. Mitchell looks forward to her trial and obtaining justice,” she added.

“The Court was required to assume at this stage that Mitchell’s allegations against Alec Baldwin were true — even though they are demonstrably false, made in bad faith, and contradict her own prior statements about what happened,” Baldwin’s attorney Luke Nikas said.

“We are pleased the Court dismissed some of her claims and look forward to disproving the rest of her case, now that she can no longer shield her misrepresentations from the evidence.”
