Special Counsel Robert Hur’s recently released report could have a “significant legal impact” on the classified documents case brought against President Donald Trump, according to a leading expert.
Former Director of National Intelligence (DNI) John Ratcliffe suggested as much during a Sunday appearance Sunday on Fox News’s “Sunday Morning Futures.”
Hur is the special counsel who was tasked with investigating whether or not Biden mishandled classified documents.
The special counsel concluded that Biden did mishandle classified docs.
However, Hur chose not to prosecute the president, because, given Biden’s current mental state, a jury would be unlikely to convict him.
Special Counsel Jack Smith, on the other hand, continues to prosecute Trump for allegedly having mishandled classified documents.
In brief, Ratcliffe seems to believe that it is possible to argue that Smith’s case against Trump should be thrown out because of Hur’s decision not to prosecute Biden.
Referring to Hur’s report, Ratcliffe, during his Fox News appearance, said:
“I think that this is actually going to have a significant legal impact beyond the public’s perception of a two-tiered system of justice – an actual impact on the same case and the same charges against Donald Trump.”
Ratcliffe continued by saying that, if he were the judge presiding over Smith’s case against Trump, he – in light of Hur’s report – would ask himself, “Why is this case even in my court?”
Ratcliffe said:
The next time special Counsel Jack Smith shows up in my courtroom, my question for him would be, “I’ve got a 300-page report from another special counsel, from the same Biden Justice Department who says that the target in that case, Mr. Biden himself, committed every element of every crime that’s set forth in here, but the Department of Justice says we’re not going to charge him, yet here you are in my courtroom saying that it’s a matter of national interest that we not only move forward with these charges, but that we absolutely do so before the November election.
“It just doesn’t jive,” Ratcliffe concluded.

Trump is to be present for the hearing presided over by U.S. District Judge Aileen Cannon that will be under seal and held in a Sensitive Compartmented Information Facility or SCIF, designed for viewing classified documents, in Fort Pierce, Florida, ABC News reported, citing court documents.
Trump has commented on Hur’s report.
On social media, Trump wrote:
“WHY ARE THEY CHARGING ME, I DID NOTHING WRONG???
“PRESIDENTIAL RECORDS ACT!”
Trump went on to answer his own question, writing:
“A TWO TIER SYSTEM OF JUSTICE. THIS IS AN ATTACK ON SLEEPY JOE’S POLITICAL OPPONENT, ME.
“IT IS LARGE SCALE ELECTION INTERFERENCE!”
